Billy Black HVAC, Inc Maintenance Agreement: Terms and Conditions

 

The following are the Terms and Conditions for use with the Billy Black HVAC, Inc Maintenance Agreement. Please read them carefully before using the Service. By signing the Agreement, each party agrees to be bound by these Terms and Conditions, including signed proposals, all payment terms, policies, practices, rules, standards and guidelines related to the Services (collectively, the “Agreement”).

Under this Agreement, Billy Black HVAC, Inc will perform one seasonal check and tune-up for each piece of covered equipment, for each annual commitment term (one in the spring, one in the fall), for a total of two visits, to be scheduled Monday through Friday between 8:00 AM and 5:00 PM, excluding holidays. The scope of the visits correspond with the Membership Level (Bronze through Diamond), as detailed on the chart below.

Billy Black HVAC, Inc  reserves the right to suspend or terminate the Agreement, if, upon inspection by our technician, the equipment is deemed to be in poor operating condition, making it unsuitable for service beyond the scope of standard maintenance practices. Upon this discovery, the technician or a customer service representative will notify the customer of the situation and recommend remedies (ie  repairs or replacements) that may be performed prior to reactivating the Maintenance Agreement.

As a service agreement customer, you agree to be contacted via phone by a live representative, or a prerecorded message/SMS message/e-mail reminding you it is time to schedule your annual tune-ups for each piece of covered equipment. If you do not wish to receive these reminders, you can opt-out by calling us at 432-312-6337 or by email at info@billyblackhvac.com.

You may request an appointment for your maintenance by calling us or emailing us at info@billyblackhvac.com. Please know that we will make every attempt to accommodate your requested date and time window, but cannot guarantee it.

If you cannot make a previously scheduled appointment, 24-hour notice is appreciated. Please understand that if we arrive for a scheduled appointment and are not able to access your home, a $50 “No-Show” dispatch fee will be charged.

During prolonged extreme weather conditions – heat and cold spells – maintenance checks may be rescheduled to accommodate Agreement members without heat or air conditioning.

This Agreement is renewable annually. Please understand that the rates for and in this Agreement may be adjusted annually to reflect any increases to associated costs, labor and/or warranty rates.

The commitment period for the Maintenance Agreement service is 12 months, and will renew for a period of the same commitment length unless the customer notifies Billy Black HVAC, Inc via email of cancellation. We appreciate the notice of cancellation no less than 30 days prior to the end of the commitment period.

If you choose to pay by credit card on file, you authorize Billy Black HVAC, Inc. to bill you through your credit card company in accordance with this Agreement. You confirm you are the owner of the credit card or have permission of the owner to approve and incur these charges.

You acknowledge and agree that Billy Black HVAC, Inc, in its sole discretion, may suspend, discontinue or refuse any and all current and future access to or use of any portion of the services at any time without notice to you in the event Billy Black HVAC, Inc reasonably believes that you have breached this Agreement. You acknowledge and agree that Billy Black HVAC, Inc shall have no liability or responsibility to you for termination in the event you breach this Agreement, and that no portion of your fees will be refunded in such case.

Under the conditions of this Agreement, you, as homeowner of the covered location, agree to:

  • Operate covered equipment according to the manufacturer’s and our technicians’ recommendations.
  • Promptly notify us of any unusual operating conditions of the equipment.
  • Permit only our service personnel to perform maintenance or repairs on the equipment.
  • No service will be rendered under this Agreement if the customer has a past-due account with Billy Black HVAC, Inc.

The effective date of this Agreement is the date of receipt of payment.

This Agreement is non-refundable, in whole or in part. If you cancel the service before the end of your contract term, no additional discount, benefits or other Agreement features will be valid. There will be no refunds or credits for partial service. No exceptions will be made. 

Agreement Services and Benefits Defined

Furnace Tune-Up: Fall Maintenance

Check:  A skilled technician will inspect the overall condition of the heating system and ensure all components are properly functioning and ready for the cold weather months, and provide a list of any pertinent recommendations, if necessary. 

If Gas Furnace:

Clean and adjust automatic controls

Clean burners

Adjust combustion for optimum fuel efficiency

Lubricate as needed

Test for combustion leaks

Test safety shutoff response

Check blower belt wear, tension and alignment

Check fuel for satisfactory operation

Visually inspect accessible ductwork

Follow manufacturer’s annual service guidelines.

If Heat Pump:

Lubricate as needed

Check defrost cycle and reverse valve operation

Check safety devices and electrical connections

Check blower belt wear, tension and alignment

Check for oil and/or refrigerant leaks

Test electrical controls for proper operation

Check refrigerant level

Check refrigerant controls and coil temperature

Check condensate drain

Adjust air volume for maximum efficiency

Visually inspect accessible ductwork

Follow manufacturer’s annual service guidelines.

If Electric Furnace:

Clean and check automatic controls

Check all wiring for loose connections and condition of insulation

Check supply voltage and amperage draw

Lubricate as needed

Test safety shutoff response

Check blower belt wear, tension and alignment

Visually inspect accessible ductwork

Follow manufacturer’s annual service guidelines.

A/C Tune-Up: Spring Maintenance

Check: A skilled technician will inspect the overall condition of the air conditioning system and ensure all components are properly functioning and ready for the hot weather months, and provide a list of any pertinent recommendations, if necessary.  

Check thermostat for proper operation

Check standard air filters (replacement of filters available for additional fee)

Check condensate drain for leakage, proper insulation, plumbing components and traps intact, secondary drain in place, drains free from obstruction, drain pan free of biological growth.

Check evaporator coil and air flow (clean coil in-place, if needed)

Check fan and motor, tighten electrical connections, check fan rotation, check blower wheel for dust/debris, check bearings for proper lubrication.

Check all accessible refrigerant lines for any leaks, kinks, crushed sections, or restrictions.

Check condenser coil for dirt/debris or damage (clean in-place, if needed)

Check condenser fan motor, tighten connections, check fan rotation, check lubrication.

Check system for proper refrigerant charge level, superheat and subcool diagnostic.

Visually inspect accessible ductwork

Follow manufacturer’s annual service guidelines.

Battery Replacement

Once each commitment term, Billy Black HVAC, Inc will replace the batteries in all carbon monoxide detectors and smoke detectors in the primary residence where covered equipment is located.  The service must be requested and must be performed in conjunction with another covered service, such as a furnace tune-up or HVAC system cleaning.

Discounted Repairs

Repair services performed while this Agreement is active are provided at a discounted rate off our standard repair charges. Please note that the discount is not applicable to equipment or system replacements. However, it does apply to IAQ products.

Discount amount per tier:   Bronze: 5% Silver 5% Gold 10% Diamond 15%

Discovery of Necessary Repairs

In the event that a covered part fails and Billy Black HVAC, Inc determines that the part or equipment has surpassed its average life expectancy or service life, Customer has the following options, one of which must be accepted in order to satisfy the continuance of the Agreement:

  • Accept and proceed with the recommended repair(s)
  • Accept and proceed with replacing the affected equipment and/or associated repair(s)
  • Accept and proceed with a full system replacement

Exclusions & Disclaimers

Billy Black HVAC, Inc cannot cover or be held liable for the following under this or any of our Agreements:

  • Acts of nature.
  • Work performed or materials provided by individuals or companies other than Billy Black HVAC, Inc.. Such instances will be cause to terminate the company’s obligation under this Agreement.
  • Repairs to products beyond their useful life, for cosmetic purposes, or to parts no longer available.

IMPORTANT: The services to be performed under this Agreement are not a guarantee against obsolescence, normal wear, or malfunctioning due to misuse or negligence, nor shall inspections be construed as an approval or guarantee of the condition of equipment.

Billy Black HVAC, Inc will maintain equipment covered by this Agreement, and provide any recommendations for repairs and/or replacements deemed necessary for the continued optimal operation of your system. However, this is not an insurance policy. Billy Black HVAC, Inc is not an insurer and will not be held liable for any and all special or consequential property damages due to or related to equipment or failure of same, including water damage due to leaks from condensate lines, indoor coils, or water lines. Furthermore, Billy Black HVAC, Inc will not be held liable for a home not continuously occupied or damages that occur during an extended period of time in which a home is vacant. Upon acceptance of this Agreement, the Customer warrants that all work areas are free of hazards (asbestos, insects, poison ivy, chemicals, mold, etc. …) and to clear or have cleared the property of any hazards or debris that would impede or prohibit an expeditious, professional installation or repair. In the event that a hazard is discovered during the course of work, all work shall cease until the Customer has taken proper abatement of the hazard at the Customer’s expense. Work will be performed unless postponed by strikes, accidents, extreme weather conditions or other delays uncontrollable by the Company.

Any disputes arising under this Agreement will be governed by the laws of the State of Texas. The Customer agrees to pay reasonable attorneys’ fees as part of any judgment against him/her arising from the enforcement of this Agreement or the invoice. If any statement or clause of this Agreement is held unenforceable, it shall not negate any other clause or statement contained herein.

Billy Black HVAC, Inc and its agents are not qualified mold, mildew, or fungus inspectors. Under this Agreement, Billy Black HVAC, Inc and its agents expressly disclaim any duty to inspect or identify or report the presence or growth of any mold, mildew, fungus, or any combination thereof, on or around any equipment covered by this Agreement.

Billy Black HVAC, Inc and its agents will be held harmless for any damages, including special damages and consequential damages, caused by the presence or growth of mold, mildew, fungi, or any combination thereof that is due to or related to equipment or failure of equipment covered by this Agreement.
